These Online Terms and Conditions of Trading (“terms”) apply to all contracts between You/your (“the Customer”) and we/us/our (“The Original Seed Shop Limited”, trading as Seed).
These terms relate to sales over the Internet only. We reserve the right to alter these terms at any time and without notice to you. Your statutory rights will not be affected.

GENERAL
The contract made by you on-line with us incorporates these terms, which shall prevail over any and all terms, proposed by you.
You shall not be able to proceed with your purchase until you have read and agreed to these terms. Please print these online terms & conditions and retain a copy for your records.
Every effort is made to ensure the complete accuracy of our website, however some prices/details contained on the website may change from time to time and it is possible that errors will occur. We will use our best endeavours to rectify any errors, as swiftly as possible but we cannot be responsible for any losses incurred.
All prices include VAT, where appropriate, at the prevailing rate and are subject to any promotional offer or discount.
We reserve the right to amend the specifications of products. Products supplied may on occasion differ as a consequence from those on display or advertised. In such instances, you will be informed of an amendment and be given the option to cancel or reselect accordingly. Unless agreed with you, the products supplied will be of equivalent value, functionality and appearance. All on-line promotional items are subject to these terms and availability. In addition the offers are limited to one per customer and per household. You cannot transfer the value of the offer products to any other products. All promotional material on or relating to www.designsbyseed.co.uk relates specifically and only to the website www.designsbyseed.co.uk.
Payment can be made by credit, charge or debit card or PayPal at the time of order. The price of any product is the price in force at the date and time of your order. You undertake that all details you provide to us for the purpose of purchasing products or services which may be offered by us on our web site will be correct, that the credit charge or debit card, which you use is your own and that there are sufficient funds available to cover the cost of the products ordered. We reserve the right to obtain validation of your credit charge or debit card details before accepting your order.
We will not be liable for any extra costs incurred by you as a result of incorrect or incomplete measurements or information supplied by you.
It is our intention to process all online orders within 2 [two] working days of receiving your order.
PAYMENT
You can order and pay for an item - or ask for a bespoke commission - in 4 ways: Online via our website; by telephone; by email; or by post. We will then telephone and email you to confirm the full details of your order, the carriage costs, and a delivery date. Despatch cannot be made until full payment - including carriage costs - has been received.
Payments online are taken through PayPal, allowing you to pay by credit or debit card and PayPal accounts. It is not necessary to sign up to for a PayPal account to pay by debit or credit card. Many currencies can be accepted via this service. It is very secure, payment details are only provided to PayPal and the information is transmitted by high level data encryption. See ‘Security’ section for further details.
Please contact us directly, to discuss payment by telephone, cheque or postal order. These orders shall not be deemed accepted until we have received your valid credit charge or debit card payment details and we have confirmed that your card issuer had authorised payment for your on-line order. We reserve the right to refuse any order placed and in such instances you will be informed via electronic mail or telephone using the contact details you registered and confirmed at the time of placing your order. Refusal may occur where the product is unavailable or we are unable to obtain authorisation for your payment. When we accept your order we will confirm acceptance to you by electronic mail to the email address you have given us during the registration procedure and on ordering.
All reasonable efforts will be made to update the website of any price changes as they occur. Should you place an order and the price of any product is discovered to be erroneous we will contact you advising you of the correct price of the goods. You can then reconfirm or cancel your order. We will not be held liable for any financial or consequential loss arising from an incorrect price being displayed on the website.
DELIVERY & ACCEPTANCE
Please refer to our delivery details, located near the basket.
If you are unable, for whatever reason, to take delivery of your goods and the goods are returned to us by the carrier, we reserve the right to charge you for any subsequent deliveries, should such extra costs be incurred by ourselves for re-delivery or return.
If we, or our nominated carrier, accidentally damage goods in the course of delivery then our liability for that damage is limited to the replacement of the goods or the value thereof.
We will not be liable for any consequential loss or damage arising out of the late or non-delivery of goods, and time and date of delivery is not of the essence of this agreement.
CANCELLATIONS AND RETURNS
Please get in contact with us if you have any queries or questions before you purchase on line. We would like you to feel completely happy with any products that you are interested in before buying. We are happy to provide further information relating to the product and additional images if necessary.
You may cancel your order at any point prior to its shipment. Once an order has been shipped it is not possible to cancel the order.
You may return any products which you have purchased from The Original Seed Shop Limited, trading as Seed, within 7 [seven] working days of their delivery to you. You can do this for any reason, including if you simply change your mind. Should you wish to return products to us, you must notify us in writing or other durable medium (including email) within those 7 [seven] working days. The products must be received by us, at the premises address (given below), within 7 [seven] working days of your notification.
While in your possession, you must keep any products you intend to return to us in good condition. You must arrange for, and pay the costs of returning the products to us. These costs are entirely your responsibility and we will not refund or credit any carriage charges that you incur as a result of the cancellation of your order. It is your responsibility to return the products by an appropriate method, in order that they are received at the premises address, within the given period, stated above. Products must be returned with all of the original tags still attached and in the original packaging. Products must also be returned with any accompanying paperwork, such as the original receipt, invoice or bill of sale (we suggest that you make copies of relevant original paperwork as proof of purchase in case of lose or damage during transit).
Upon receipt of the products, and subject to them being in satisfactory and resalable condition, you will then be entitled to a refund or credit note, from us, which will be processed as soon as possible, but in any event within 30 [thirty] days. Please note that the refunds will be made using the same method as the original payment (i.e. a credit or debit card).
Please note that returned products will not be accepted if they have been used, soiled, cleaned or altered in any way.
Should products be deemed unacceptable for return to stock, for any of the reasons given above, the products will be held at the premises address for collection by you. Should you wish the products to be returned to you by courier service, you will be responsible for any charges incurred.
WARRANTIES
If you receive damaged products, note that fact on the delivery note, even before you open the packaging to examine the contents. If you are unable to open a damaged package in the presence of the carrier, make sure that you sign for it as ‘damaged package - products not yet inspected’, or something similar, so as to warn the carrier that a claim may be forthcoming.
To cover these circumstances, please contact us by email or telephone with as much detail of the damage or loss as you can provide as soon after delivery as possible, so that the Company can arrange for the dispatch of replacement products and follow up the difficulty with the carriers. Please do not return damaged products to the company unless or until requested to do so as this may incur additional costs unnecessarily.
We will happily arrange an exchange, credit or refund of the full purchase price paid for the products, once we have examined them, but the cost of the delivery cannot be refunded. Please note that the refunds will normally be made using the same method as the original payment i.e. a credit or debit card.

ORDERING SAFELY

DELIVERY
STOCK ITEMS
In stock items will be despatched within 1-4 days of receiving your order. The exception is for art pieces which will be despatched within 7 days.
For any items which are more urgent or require Saturday delivery, please contact us and we will endeavour to meet your request. However, on occasions, there maybe a wait.
OUT OF STOCK ITEMS / COMMISSIONED ITEMS
We constantly try to keep the site as up to date as possible, however in some instances products that are shown for sale on the site may have already been bought previously as many of our products are one offs. In such cases we will contact and notify you as soon we are aware. If it is possible for us to source similar products again, we will give you that option. If we cannot fulfil your order within these 30 days we will contact you to reconfirm or cancel your order. Should you wish to cancel your order, any monies paid will be refunded in full. We will not be held liable for any financial or consequential loss arising from us not being able to complete your order.
Delivery for commissioned work will be quoted at time of enquiry.

The delivery brackets are:
1. Standard delivery for very small items, using Royal Mail special delivery, £4.95
2. Standard delivery for small items, using Royal Mail special delivery, £6.95
3. Medium fragile and lightweight items sent by courier, £12.95
4. Medium fragile heavyweight items and small art sent by courier, £14.95
5. Large fragile items and medium art sent by courier, £24.95
6. Large art sent by courier, £49.95
7. Extra large art sent by courier, £69.95
Multiple item orders: Seed will charge full delivery for the greatest delivery value and half delivery charge for all items thereafter.
All delivery options will require a signature on delivery. We do not accept any responsibility if delivery is delayed as a result of there being no one present to sign for the package.
